By using the Service, you agree to be bound by these TUC, which establish a contractual relationship between you and us. If you do not agree to these TUC, you may not use the Service.

Additionally, you agree not to use this site for any illegal purposes.

3. Service Overview

Through the Service, Device Finder enables the tracking of the current location of an individual who has given consent to be tracked. The Service functions by sending an SMS to the recipient, notifying them that someone wishes to know their location. If the recipient of the message expressly agrees, their geolocation at that specific moment is shared with the requesting party.

Under no circumstances will the geolocation extend beyond the specific moment in which consent was given.

The monthly payment for the service does not guarantee that the person you are searching for can be tracked. The Service only provides the means to attempt this. If the person is missing, or their mobile phone is stolen, turned off, or they do not accept the link sent via SMS, we will not be able to obtain their GPS position.

However, Device Finder does not control these external sites or their content, which are subject to their own terms and conditions. Consequently, Device Finder is NOT responsible for the quality, truthfulness, or accuracy of the information found on these external sites.

5. Age Requirements

By using the Service, you confirm that you are of legal age and possess the legal capacity to be bound by this agreement. You agree to use the Service in accordance with its terms and conditions, which you fully understand and acknowledge.

6. Intellectual Property Rights

The prices of the plans offered by Device Finder are displayed in euros (€) or Lei (RON) and include the applicable value-added tax (VAT) for these services in Romania (19%).

If the client's place of residence or address is in another member state of the European Union or a non-EU state, the plan's price may be subject to modifications if the applicable tax rate is different.

9. Payment Methods

Payment for the contracted Service can be made using:

• VISA or MasterCard credit or debit card, with the amount being charged at the time of purchase.

In this regard, Device Finder informs credit and debit card holders that they are responsible for transactions on the online store. Transactions are made on a secure page using SSL technology to ensure the security of data transmission.

10. Offers Validity

The Service offered, along with the prices of any plans or subscriptions, will be available for purchase as long as they are accessible through this website.

In all cases, Device Finder reserves the right to make any modifications to the Service deemed appropriate, including updates to products and services in accordance with market conditions.

Regarding the prices displayed on the website, Device Finder reserves the right to change them without prior notice.

We inform you that despite the updates made to the prices of the Service, errors may occur. We will promptly correct any errors that appear, but they will not be binding on the Service.

11. Consumer Guarantees

All rights guaranteed to you as a consumer and user under the applicable laws are assured.

In any case, while Device Finder will make all reasonable commercial efforts to provide the Service, you understand that: a) the user's geolocation requires the express consent of the recipient; and b) even with their consent, the state of technology does not guarantee that their location will always be obtained or that it can be done with sufficient precision.

In any case, and to the extent permitted by law, Device Finder reserves the right to reject, suspend, or cancel the provision of the Service at its sole discretion.

12. User Responsibility

To use the Service, you confirm that: a) you have lawfully obtained the telephone number that you want to track with the owner’s prior consent; and b) you do not intend to use the Service for any unlawful purpose.

Additionally, to the extent permitted by applicable law, Device Finder shall not be responsible for any loss of data or programs as a result of using the Service.

13. Security Measures

Device Finder ensures the security of the Service in accordance with current technological standards.

However, Device Finder cannot guarantee complete security of the Service, although we commit to addressing and implementing appropriate corrective measures to rectify any possible security breach as soon as possible.

The user agrees to notify the Service immediately via email at contact@device-finder.com of any loss of information, unauthorized access or use by third parties, or any situation that may result in the identity theft of other users.

Device Finder shall not be responsible for damages that may occur when using the Service if they result from unforeseeable technical problems or, if foreseeable, are unavoidable. Similarly, Device Finder shall not be responsible when the defective action of the user, whether the sender or recipient of the message, causes damage.

14. Subscription and Refund Policy

Access the Service using a 24-hour trial for 0.69€. After this period, if you do not cancel the account, your subscription will automatically convert to a monthly plan for 39.90€, renewing automatically for the same period until terminated.

Unless you cancel your subscription, you authorize us to charge the monthly subscription fee to your payment method.

You may cancel your subscription to the Service at any time, and will take immediate effect. To the extent permitted by law, payments are non-refundable, and we do not provide refunds or credits for partial monthly subscription periods.

If you have subscribed to the Service, and the corresponding amount has been invoiced after the initial trial period, but you have not sent any messages, you may request a full refund of the amount charged if the request is made within 14 calendar days of subscribing to the Service.

If the credit card you registered with does not have sufficient funds when charging the monthly payment, we will make additional attempts to charge your subscription according to the following schedule:

• First attempt: Day 2 (end of the trial period).
• Second attempt: Day 7 (5 days after the first attempt).
• Third attempt: Day 13 (7 days after the second attempt).
• Fourth and final attempt: Day 20 (7 days after the third attempt).

If the payment is not successful after the fourth attempt, the subscription will be canceled, and access to premium services will be revoked.

15. Right of Withdrawal

By contracting the Service, you are agreeing to the supply of digital content not provided in physical form.

Therefore, once the content has begun to be delivered, you accept and understand that the right of withdrawal, as established in the applicable consumer protection laws in Romania, does not apply to this contract.

16. Modifications and Severability

We may update the terms and conditions of the Service in the future, as well as the characteristics and functions of the Service itself.

We will inform you about any changes to the terms and conditions by placing a notification in a visible place on our website and/or by email.

If any clause included in our terms and conditions is declared, fully or partially, null or void, it shall only affect the specific provision in question or the part that is null or void. The rest of our terms and conditions shall remain in effect, and the provision in question, or the affected part of it, shall be considered excluded.

This service is governed by Romanian law.

To simplify the resolution of complaints through civil proceedings and to reduce costs, we do not exclude the possibility of submitting to an Equity Arbitration of the Court of Arbitration of the Chambers of Commerce and Industry.
